Terms & Conditions These terms and conditions apply to the Sullivan’s Jewelers’ website located at www.stacisullivansjewelers.com, Sullivansjewelers.shop, and all associated Websites linked to www.stacisullivansjewelers.com by Sullivan’s Jewelers, its subsidiaries and affiliates (collectively 'the Site'). Please read these terms and conditions (the 'Terms and Conditions') carefully. BY USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. These Terms and Conditions govern your use of, and any purchase from, the Sullivan’s Jeweler’s Site, and constitute an agreement between you and Sullivan’s Jewelers. Sullivan’s Jewelers reserves the right to change or modify any of these Terms and Conditions or any policy or guideline of the Site at any time, and in its sole discretion. Any change or modification will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and Conditions and any other applicable policies from time-to-time to understand the terms and conditions that apply to your use of the Site. If you do not agree to the amended terms, you must stop using the Site. Returns/Exchanges Sullivan’s Jewelers will honor refunds or exchanges for store credit on specified items for up to 10 business days post pickup/delivery. All special orders, personalized items, one-of-a-kind, and consignment jewelry are final sale and not eligible for return or exchange. All returns/exchanges require a pre-assigned Return Merchandise Authorization Number provided by Sullivan’s Jewelers. Please contact Sullivan’s Jewelers at sullivanjeweler@gmail.com for a Return Merchandise Authorization Number within 3 business days of jewelry pickup/delivery. All jewelry must be in the original condition to qualify for a refund/exchange/store credit. Sullivan’s Jewelers reserves the right to inspect all jewelry prior to refund or exchange for wear or damage. In order to complete a return or exchange, Sullivan’s Jewelers requires a receipt or proof of purchase, along with the original packaging. Returns/exchanges by a gift recipient without proof of purchase will require the name of the original purchaser. Store credit will be valid for 90 days. A restocking fee of 10% is deducted on all refunds. Shipping for returns or exchanges is at the purchaser’s expense. Shipping All Sullivan’s Jewelers shipments require an adult signature at the time of delivery. Sullivan’s Jewelers takes the utmost care to deliver shipments within the timeframe listed at checkout. Depending on where the package is being shipped, the time it may take for a product to be received can vary. All shipments are insured for the amount of the purchase price and shipped through UPS, FEDEX or USPS; for more information, please see the carrier’s policies. Sullivan’s Jewelers requires all shipping costs to be paid for by the customer for returned or exchange items. All shipping costs are nonrefundable. All return shipments require a Return Merchandise Authorization Number which can be obtained by emailing sullivanjeweler@gmail.com. For more information about returning an item, read our policy on 10 Day Returns. If you are making a shipment to Sullivan’s Jewelers, we recommend purchasing insurance and selecting a trackable shipping method. Sullivan’s Jewelers is not liable for any products lost or damaged during return shipping. Accepted Payment Methods: Visa, MasterCard, American Express, Discover, Cash, Zelle, PayPal Payment Information After you have selected your jewelry and provided shipping information, you will see a prompt for your payment details, such as your credit card information and any promotional codes or gift cards you may have. By entering your payment information and submitting your order, you authorize us and our third party payment processors to charge the amount of the order to your selected payment method. Layaway/Finance Options Sullivan’s Jewelers offers a 0% interest, 3-month layaway program. Layaway requires a down payment of 30% of the sale price. No alterations (sizing, engraving, etc.) of the item will be made until paid in full. Layaway payments are NON-REFUNDABLE. If the customer fails to pay for the item in full, any money paid towards the layaway will be converted to store credit. Store credit is valid for 90 days from the date of issue. Passage of Title Title for goods purchased passes from Sullivan’s Jewelers to the purchaser’s designee at the time that goods are delivered to the designee. Repairs Sullivan's Jewelers recommends routine (bi-annual) jewelry cleaning & inspection. If repairs are needed, Sullivan’s Jewelers will do their best to repair your jewelry onsite. If the jewelry repair is a manufacturer defect or under manufacture warranty and needs attention from the manufacturer itself, shipping, insurance and handling charges may be incurred. The minimum charge to ship to the manufacturer is $35. The majority of repair estimates will be given within 7-10 business days for repairs performed onsite. Outside jewelry manufacturers may require additional time. Estimated dates on the repair receipt are purely estimates, as exact dates of service may be unknown due to parts availability from manufacturers or other circumstances. You will be contacted after your jewelry has passed Sullivan's Jewelers rigorous quality control inspection and is ready to be picked up or shipped. Any repairs that go unpaid or are not picked up within 60 days from date of completion will be considered forsaken and retained as the property of Sullivan's Jewelers. All articles which are antique, irreplaceable, fragile or brittle nature, and/or susceptible to damage from light, heat, or moisture are accepted on the condition that the customer accepts all risks with respect to any service requested to be performed. Customers leaving jewelry in the care of Sullivan’s Jewelers will not hold the company liable if damage occurs during routine cleaning, repairing, and inspecting. This store, including its employees, accepts no responsibility for the condition or identification of jewelry, stones or watches. You also affirm these stones are not altered by fracture filling, laser drilling, and/or by any other treatment means, unless specifically listed. The business entity Sullivan’s Jewelers will not act as an issuer of the jewelry item(s) listed and submitted to for repair only. Precautions are taken to keep all customers jewelry safe and secure while in the care of Sullivan's Jewelers. Any unforeseen circumstances will be handled on a case by case basis and insurance may be used to settle a claim. Repair receipt or valid government issued identification card must be presented to pick-up jewelry left in Sullivan's Jewelers care. Sullivan’s Jewelers store policy insists for the owner of the jewelry on hand for repair to notify the business in advance if a person other than the one(s) named on claim receipt will be picking jewelry up. Sullivan’s Jewelers reserves the right to request an approval of another party picking up your item in writing. Warranty Quality, service, and value have been the cornerstones of the Sullivan family legacy for three generations. Sullivan’s Jewelers will cover manufacturing defects to the metal and accent diamonds or gemstones in your Sullivan’s jewelry for up to one year from purchase. Sullivan’s Jewelers reserves the right to void this warranty if the damage was caused by circumstances beyond a manufacturing defect. Please note: Primary/center stones and estate/consignment jewelry are not included in this warranty. To inquire about Sullivan’s Jewelers warranty, please contact SullivanJewel-er@gmail.com. Product Availability On occasion, you may be able to place a product in your shopping cart and submit your order for processing, but your order is subsequently cancelled due to unavailability of product. You acknowledge that products may sell quickly and there may be a short period of time after an order has been submitted, but where the product is no longer available. You agree that we may cancel your order after you have received an Order Confirmation without penalty. On very rare occasions, you may receive a Shipping Confirmation from us, but the product is no longer available in our or our third party fulfillment provider's inventory. You agree that we may rescind our acceptance and cancel your order without penalty if we are unable to ship the product you ordered due to unavailability. If you're interested in a piece of jewelry that is currently on back order, contact us and we can tell you when the item will be back in stock. Sometimes with the volume of orders we receive, an item may go out of stock before we are able to post a notification on the Site. If this happens, we will contact you directly to discuss possible options. Order Approval and Cancellation Receipt of an order confirmation message from Sullivan’s Jewelers only confirms that your order request has been received. Customer orders are not accepted by Sullivan’s Jewelers until the time they have been processed and approved at our headquarters. Sullivan’s Jewelers is not obligated to complete a customer order, and reserves the right to cancel products or services to any customer for any reason at any time. The customer's sole remedy in such cases will be the full refund of any funds that we have collected in reference to the canceled products and/or services. Comparison Purchasing To keep our prices low, we do not allow comparison purchasing. Comparison purchasing is the act of buying several items with the intent of keeping the one you like best and returning the remainder. This causes undue restocking and inventory overhead and can be very costly. Information On Our Site At Sullivan’s Jewelers, we make every attempt to ensure that our online catalog is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs; and since every computer monitor is set differently, color and size may vary slightly. Information that we communicate is not a binding contract, and should not be treated as such. The sole remedy of a customer acting on incorrect information is to request a cancellation of the order placed as a result of this incorrect information. If an order has been shipped, the customer agrees to either return the product for full credit or pay the difference between the actual and charged prices. Please review our Return Policies. Our objective is to provide you with as much information and detail about your prospective purchase as possible so that you can see the beauty and shape of a particular item. In compliance with industry standards and FTC regulations, Sullivan’s Jewelers states that carat total weight in all purchases may vary 0.05 carats from stated weight. On the Site, we provide the measurement of our products based on manufacturer specifications. Slight tolerances may be accounted for based on finishing during the manufacturing. Width tolerance on machine made wedding bands of 0.20mm is allowed. Cast manufactured rings can vary slightly more. For gemstone and pearl measurements, a tolerance of 0.25mm is allowed. For diamond jewelry set with multiple diamonds, we provide the estimated total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds. If stated as a minimum, all diamonds within the piece are at or above the stated quality. If expressed as an average, collectively the quality is equal to or exceeds the grade stated. Site Content The Site and all content and other materials, including, without limitation, the Sullivan’s Jewelers’ logo, and all designs, text, graphics, pictures, selection, coordination, 'look and feel', information, data, software, sound files, other files and the selection and arrangement thereof (collectively, the "Site Materials") are the proprietary property of Sullivan’s Jewelers or its licensors or users and are protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. Use Of The Site You are granted a personal, limited, non-sublicensable license to access and use our Site and electronically copy, (except where prohibited without a license) and print to hard copy portions of our Site Materials for your informational, non-commercial and personal use only. Unless explicitly stated herein, nothing in these Terms and Conditions shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. This license is revocable at any time. Infringer Policy In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, Sullivan’s Jewelers has adopted a policy of terminating and barring, inappropriate circumstances and at Sullivan’s Jewelers sole discretion, site users or account holders who are deemed to be repeat infringers. Sullivan’s Jewelers may also at its sole discretion limit access to this site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
